Making a Complaint Before You Take Court Action
The process usually starts with a written complaint to the agent, following the complaints procedure in your contract or on their website. Gather your evidence first: emails, rent statements, inspection reports and your signed management agreement. Give the agent a fair chance to fix problems.
If the agent's final decision does not resolve the dispute, escalate to the independent complaints body your agent belongs to. Every letting agency in Wales must join a letting agent redress scheme, either The Property Ombudsman or Property Redress. Agents must also be licensed under Rent Smart Wales, and your local council holds enforcement powers where property professionals fall short.
A redress scheme has limits on what it can award, so where losses are substantial, court action is often the better route. Legislation moves quickly, with the Renters' Rights Act reshaping matters in England while Wales follows its own rules, so it is crucial to seek advice early.
