What the Law Requires of a Cardiff Letting Agency
Agents managing property in Wales must hold a licence from Rent Smart Wales, and operating without one is a criminal offence. They must also belong to an approved redress scheme, such as The Property Ombudsman, and publish a complaints procedure. None of that removes your own legal obligation as the landlord, which is why an agent's failures land on you. Common breaches include:
- Not keeping you updated on issues that later result in a claim against you
- Advising you late, or wrongly, on rent arrears
- Failing to suggest a guarantor agreement, or preparing inadequate documentation
- Allowing you to fall into breach of the legislation, for example by letting an unlicensed HMO arise

Letting Agent Responsibilities
Letting agents have a duty of care primarily towards the landlord. While they are responsible for keeping tenants’ money protected, the primary client of a letting agent is the landlord. This means the letting agents are contractually obliged to put the landlord’s best interests first, providing guidance and best practices.
