Why are Landlords being issued Rent Repayment Orders

Why are Landlords being issued Rent Repayment Orders?

Tenants can apply to a tribunal for a rent repayment order. The main reason for issuing a rent repayment order is because the landlord has failed to obtain the necessary license to rent, but it can also be for a number of offences listed below:
  • Failure to comply with an improvement notice or claim for disrepair
  • Failure to comply with a prohibition order
  • Breach of a banning order
  • Using violence to secure entry to a property
  • Illegal eviction or harassment of the occupiers of a property

How Can We Help?

Our team has successfully defended a number of rent repayment orders for landlords. There are a number of factors to look into that can be raised in defence:
  • Did the landlord have control of the property at the time?
  • Was the landlord advised by the agent of issues at the property?
  • Did the landlord act reasonably?
  • Was the correct procedure followed by the tenant?
  • Has the case been brought out of time?
  • Has the claim been brought against the right defendant?
  • Perhaps you have acted naively rather than purposely failed to obtain a license?
  • Is there a negligence claim against an agency or a conveyancing lawyer for you?
At NewBold Solicitors, our experienced team can help you to resolve your rent repayment order disputes. If you need help or advice regarding a rent repayment order then please don’t hesitate to contact our friendly and informative team of rent lawyers who can help defend you.
