Our Probate Services in Newport

  • Obtaining probate: we contact asset holders, value the estate, prepare the HMRC account and probate forms, pay any Inheritance Tax due and apply for the grant.
  • Full estate administration: once the grant is issued, we close accounts, transfer property, settle debts and tax, prepare estate accounts and pay the beneficiaries.
  • Intestacy: where there is no will, we work out who inherits under the intestacy rules and apply for Letters of Administration.
  • Deeds of variation: if beneficiaries want to change how the estate passes, we prepare a deed of variation for a fixed £950 plus VAT.

What Does a Probate Solicitor Do?

A probate solicitor helps the executor named in a will, or the administrator where there is no will, get the legal authority to deal with the estate. That authority is called a Grant of Probate, or Letters of Administration if the person died without a will. Without it, banks, pension providers and the Land Registry will not usually release or transfer the assets.

Clear Fixed Fees for Probate

You should know the cost before you commit. Obtaining a Grant of Probate or Letters of Administration costs a fixed £795 plus VAT where the estate is worth less than £325,000. If there is no will, an extra £288 plus VAT applies, and the £526 Probate Registry fee is paid on top. Copies of the grant cost £2 each. Larger or more complex estates are charged at an hourly rate, and we give you an estimate at the start.

How Long Does Probate Take?

We usually submit the application within 6 to 8 weeks of receiving your instructions, and the grant tends to arrive around 16 weeks after that. Executors should normally wait six months from the date of the grant before paying out the estate, as this protects them from claims under the Inheritance (Provision for Family and Dependants) Act 1975.
